Revealed: How George Osborne asked Charles's permission for law change that made the Royal Family millions
Prince Charles was personally consulted by George Osborne about a controversial change to the law which has significantly boosted the Royal Family’s finances.
Letters obtained by The Mail on Sunday under Freedom of Information laws show that the Chancellor ‘humbly’ sought the Prince’s permission to radically overhaul the way the Royal Family is funded.
The correspondence, which has been branded a ‘scandal’ by critics, sheds light on a secret process whereby Ministers are required to submit draft copies of Bills to the Prince in his role as the Duke of Cornwall.
Beth Russell, the Chancellor’s principal private secretary, sent a draft copy of the Sovereign Grant Bill to Sir Michael Peat, the Prince’s private secretary, on June 16, 2011.
She wrote: ‘I should be grateful if you could lay this letter, with my humble duty, before the Prince of Wales and seek His consent so far as the interests of the Duke of Cornwall are concerned to place those interests at the disposal of Parliament for the purposes of this Bill.’
Miss Russell outlines the Bill’s main proposals and points out that the introduction of a new single grant to the Royal Household would generate more income for the Royal Family and would not have to be continually renewed by Parliament.
She wrote: ‘The new grant is normally to be set equal to 15 per cent of the profit of the Crown Estate two years prior. Linking funding to Crown Estate revenues in this way should provide semi-automatic incremental growth in the grant, reducing the need for regular parliamentary intervention.’
Sir Michael’s attention is also drawn to Section 9 of the Bill which has particular implications for the Duchy. Miss Russell explained that for the first time, any future heir to the Throne could be funded by the Duchy even if they did not hold the title of Duke of Cornwall.
At present only a male heir, who is the son of a reigning Monarch, can hold the dukedom. Some commentators believe this particular change will financially benefit the first-born child of Prince William and the Duchess of Cambridge.
Ministers seek Prince Charles’s consent on all legislation which could threaten the financial interests of the Duchy of Cornwall, which has land and property holdings worth more than £700 million.
The Prince raised no objection to the proposals and on June 30, Sir Michael wrote: ‘This is to confirm that the Prince of Wales has given his consent to the Sovereign Grant Bill so far as the interests of the Duke of Cornwall are concerned.’
The revelation that the Government sought the Prince’s consent for the Bill will plunge the legislation into fresh controversy. Critics have branded the decision to link the level of support to the performance of the Crown Estate’s £6 billion property empire as over-generous. It is believed the grant could be worth as much as £34 million in its first year of operation.
Since 2005, Ministers are believed to have sent the Prince 12 draft Bills covering everything from road safety to gambling.
Last week it was revealed that in 2008, they sent the Prince a four-page letter about the Marine and Coastal Access Bill. A spokesman for Clarence House said last night that the Prince had never vetoed any proposal but critics remain unconvinced.
Ian Davidson, a Labour MP, said: ‘This is a scandal and an anachronism. The idea that the Prince has a right to be consulted on legislation which might impact on his interests belongs to a bygone era.’
John Kirkhope, a notary who secured the release of the marine Bill letter through an FOI request, said: ‘The Duchy say they have never declined to give consent. But that is not the issue. The issue is whether legislation has ever been amended before consent was granted.’
The Clarence House spokesman said: ‘It is a long-established convention that the Prince, as Duke of Cornwall, is asked by Parliament to provide consent to those Bills which Parliament has decided would affect Duchy of Cornwall interests.’
A Treasury spokesman said: ‘The Government is required to get the prior consent of the Prince of Wales for certain pieces of legislation affecting his interests through the Duchy of Cornwall or other titles.’

George Galloway wins Bradford West by-election
Respect Party candidate George Galloway has taken the Bradford West parliamentary seat from Labour, winning the by-election by 10,100 votes.
Mr Galloway, expelled by Labour in 2003, said it was the "most sensational victory" in by-election history. He received 18,341 votes - a 56% share.
He said his victory represented a "total rejection" of the major parties.
At the 2010 General Election, Labour's Marsha Singh, who resigned on health grounds, won with a majority of 5,763 .
The party had held the West Yorkshire seat since 1974, except for a brief period in the 1980s when the sitting MP defected to the SDP.
Labour candidate Imran Hussein came second with 8,201 votes as the party's share of the vote was 20% down on its 2010 figure.
Conservative candidate Jackie Whiteley was third, with 2,746 votes. Jeanette Sunderland, of the Liberal Democrats, secured 1,505 votes.
Mr Galloway, who co-founded the anti-war Respect Party after being expelled by Labour because of his opposition to the Iraq war, said the result represented the "Bradford Spring".
He said the "mammoth majority" and "mammoth vote" represented a "total rejection" of the three major parties in the British political system.
Mr Galloway urged his former party to turn away "decisively" from the course set by former Prime Minister Tony Blair.
He said Labour "must stop imagining that working people and poor people have no option but to support them if they hate the Tory and Liberal Democrat coalition partners.
"They have to stop supporting illegal, bloody, costly foreign wars because one of the reasons why they were so decisively defeated this evening is that the public don't believe that they have atoned for their role in the invasion and occupation of other people's countries and the drowning of those countries in blood."
Mr Galloway urged his former colleagues to "stop taking their supporters for granted" and "unite the coalition" it once had.
The Respect politician was mobbed by supporters as he left the count.
Labour's candidate did not make a speech after the results were announced, but Labour MP Toby Perkins said the Bradford West result was "desperately disappointing".
He attributed Mr Galloway's success partly to his celebrity status from having appeared on TV reality show Celebrity Big Brother which he said had been "a very significant factor".
Mr Perkins said: "I think frankly there wasn't a lot the other parties could do about it. [Voters had] seen him on Big Brother.
"They wanted him on their streets and now they've got it, and let's hope that he lives up to the promise that he's made to them and actually delivers on the optimism that surrounds his campaign."
'Lone, loud voice'
A Liberal Democrat spokesman said the party was "clearly disappointed" with the result.
"While we were always expecting to fight for fourth in this election, it is quite astonishing for Labour to lose this seat and the Conservatives see such a drop," he said.
Kris Hopkins, the Conservative MP for nearby Keighley, said his party had not won Bradford West for 42 years, so "there were not high expectations".
"It is Labour that have been wiped out tonight. It must be a huge humiliation for Ed Miliband and his team," he added.
BBC Yorkshire political editor Len Tingle said there had effectively been two campaigns in the seat - one with the three main UK parties focused on the economy and jobs, and the other run by Mr Galloway which had his party's anti-war message at its forefront.
BBC political correspondent Chris Mason said there had been a feeling that Mr Galloway might split the left-wing vote, but he had not been expected to defeat Labour.
Our correspondent said the margin of the victory was "extraordinary", adding that it was not simply a matter of the Labour Party losing to Mr Galloway but "being thumped" by him and his party.
He predicted that, once in the House of Commons, Mr Galloway would be "a lone voice but a very loud one".
It is the second time Mr Galloway has upset the political odds - he pulled off one of the results of the 2005 General Election when he overturned a large Labour majority in London's Bethnal Green and Bow to become the Respect Party's first MP.
His win in Bradford West is a remarkable comeback after disappointing showings at the 2010 General Election and the 2011 Scottish Parliament elections.
The outcome was being closely watched by all the parties as a snapshot of voter opinion, following last week's Budget and ahead of council and mayoral elections next month.
The Conservatives came second in the constituency in 2010, on a 65% turnout, ahead of the Liberal Democrats in third. Respect was fifth in 2010.
Prior to Bradford West, there had been five by-elections in England and Scotland since the start of the current Parliament - Oldham and Saddleworth, Barnsley Central, Leicester South, Inverclyde and Feltham and Heston - with Labour retaining all five seats.

MP Eric Joyce goes berserk in bar brawl at Commons
A Labour MP was dragged away in handcuffs after going berserk in a House of Commons bar and headbutting a fellow MP.
Ex-Army major Eric Joyce hit at least three MPs, including a Labour whip, in a rage last night when they tried to calm him, it was claimed.
"There was blood spilled - it was like the Wild West in there," said one stunned MP. Police were called but it apparently took five Commons security officers to restrain Mr Joyce, 51.
A glass door was smashed as they dragged him away, still struggling. The MP for Falkirk was taken to Belgravia police station, where he spent the night and was still being held today.
Ed Miliband suspended him from the Labour Party at 10am, pending an investigation.
The astonishing fracas took place in the
Strangers Bar, where MPs can entertain guests. Minutes earlier, a delegation of VIPs from the Canadian parliament, including its Speaker,had been sipping drinks in the room. Witnesses say Mr Joyce arrived in the wood-panelled bar at 10pm.
At one stage he allegedly complained: "There are too many f***ing Tories in here."
One source said he started singing and dancing at first but "flipped" when other drinkers asked him to be quiet.
"He seemed to have had a lot to drink and was asked to quiet down," said the source. "Then he flipped. It was not really a brawl or a fight, he just flipped. He then started lashing out."
Tory Alec Shelbrooke, MP for Elmet & Rothwell, urged Mr Joyce to calm down and was allegedly caught up in the fracas.
A witness told the Standard that Mr Joyce then turned on the Tory MP for Pudsey, Stuart Andrew, and allegedly headbutted him. "Eric had been en-
gaged in banter with other tables but suddenly he just started lashing out," said the witness.
"Poor Stuart was just having a quiet pint and minding his own business and Eric headbutted him. Stuart was just in the wrong place at the wrong time."
Several other MPs tried to calm Mr Joyce down, including Labour whip Phil Wilson, who was hit. One woman MP, Thurrock Tory Jackie Doyle-Price, stepped bravely between Mr Joyce and the fracas. The witness said: "He calmed down then."
Mr Joyce then allegedly returned to Mr Andrew and headbutted him a second time. Mr Andrew is understood to be pressing charges but tweeted today: "I'm OK."
Police were called at 10.50pm and it took five security officers to bring the situation under control. Mr Joyce was handcuffed. Sources said he was led away still struggling and the glass window in a door along the corridor was broken.
A Scotland Yard spokesman said: "We were called at approximately 10.50pm last night to reports of a disturbance at a bar within the House of Commons.
"A man aged in his fifties was arrested by officers on suspicion of assault. He remains in custody in a central London police station. Inquiries continue."
Mr Joyce, an MP since December 2000, served in the Army Education Corps before pursuing a career in politics - serving as an aide to several senior ministers, including former defence secretary Ben Ainsworth.
He is understood to have had marriage problems and colleagues have noted that he started drinking more heavily in recent months. In 2010 he resigned as shadow Northern Ireland minister after pleading guilty to failing to provide a breath test.
From 2003 Mr Joyce served as a Parliamentary Private Secretary to a number of government ministers. He quit as PPS to Mr Ainsworth in 2009 because of his concerns over the war in Afghanistan. Prior to that he had been an aide to John Hutton, including the period when he was defence secretary, Mike O'Brien and Margaret Hodge.
According to his constituency webpage, he has a constituency office in Denny and a Westminster office in Portcullis House.
During his time in Westminster he has held an interest in defence and military issues, the website adds. Earlier last evening Mr Joyce had tweeted that he was in a Commons committee. And on February 20 he had tweeted: "Ok, who's the hardest boxing correspondent in the country? There's only one way to find out..."
The Labour Party said: "This is an extremely serious incident. We have suspended Eric Joyce pending the results of the police investigation."
