    MASONIC TASER VANCOUVER, B.C. - The former judge conducting a public inquiry into Taser use has concluded the stun guns can kill or seriously injure people but that Canadians are better off with the controversial weapons than without them. Immediately after Thomas Braidwood released his report Thursday, the B.C. government ordered all police, sheriffs and corrections officers in the province to "severely restrict the use of the stun guns."

    But the RCMP, a federally regulated force that polices about 70 per cent of British Columbia, said it won't comply with the government's directive until it's had a chance to review Braidwood's report. The inquiry was prompted by a 2007 incident involving the Mounties at Vancouver International Airport, where four officers confronted, then Tasered Polish immigrant Robert Dziekanski, who died on the floor of the arrivals area. At a news conference, Braidwood slammed the B.C. government for "abdicating" its responsibility for establishing standards for Taser use.

    "Conducted energy weapons are unique - they are the only weapon designed to cause intense pain and to incapacitate through an electrical current," he said in releasing a report into the use of Tasers among police forces Braidwood said Tasers were introduced without prior independent government testing of their electrical safety or Canadian Standards Association approval.

    The officers are even given special dispensation to take eight pagan holidays a year, including Halloween and the summer solstice. PC Andy Pardy, of Hertfordshire Police, met with Home Office chiefs this week to push for the creation of an officially sanctioned pagan support group for police officers around the UK. Pagans worship nature and believe in many gods, and practices include witchcraft and druidism.

    PC Pardy, who has been an officer for the past seven years, is a heathen - which means he worships Norse gods, including hammer-wielding Thor, the one-eyed Odin and the god of fertility, complete with huge phallus, Freyr. The neighbourhood beat manager told Police Review: 'Paganism is not the new age, tree hugging fad that some people think it is. 'It is not the clandestine, horrible, evil thing that people think it is. A lot of people think it is about dancing naked around a fire. But the rituals are not like that.

    'It involves chanting, music, meditation, reading passages and for pagans the practices are seen to have the same power as prayer does for Christians.' He added: 'It has been practiced in this country since before the concept of God arrived here. It is all about dedication to nature. 'Most Pagans practice some kind of conservation work as well, to give something back to the planet.'

    PC Pardy, also an equality and diversity representative for the force, said the Pagan Police Association would 'provide support and guidance' to pagan police officers in the UK who want to fit their beliefs around their police work. Hertfordshire Constabulary allows PC Pardy the eight pagan holidays off each year, including Halloween - which signifies the pagan new year - and the summer solstice in June. The days are deducted from his annual leave, but because of his religion these days off are set in stone.

    There were 30,500 people practicing paganism in England and Wales in 2001, according to the Office of National Statistics. Last year the Home Office introduced the pagan oath for use in the courts. It is not known how many pagan police officers and staff there are in the UK. A spokesman for the Home Office confirmed the meeting with PC Pardy this week.

    He added: 'The Government wants a police service that reflects the diverse communities it serves. 'It is down to individual forces to make reasonable adjustments to accommodate the religion or beliefs of individual officers, as far as operational requirements permit.' PC Andy Hill, of Staffordshire Police, is a practicing Wiccan - a pagan witch - and admits using spells could help gain a promotion on the force.

    Founder of the Pagan Police Group UK, a website for pagan police officers and their families launching on 1 August, PC Hill said: 'Wiccan has always been a bit of a taboo religion, there are lots of misconceptions around it. 'This is nothing to do with black magic, or devil worshipping. Witchcraft is not the hocus pocus, puff of smoke, turning people into frogs stuff you see on the TV. It is working with nature for good.' But PC Hill, who is a response officer, says the pagan spells do not stretch to catching criminals.

    He said: 'You cannot alter someone's free will with witchcraft but you could use it if you had a promotion coming up, or you were worried about a friend or a particular area of work.' Spells used are individual to the practitioner, but they can involve recitations, alters, flowers and herbs, he added. PC Hill, who has six years service and has also been a practicing Wiccan for seven years, said he was motivated to set up his website after he noticed an increased number of witnesses saying they were pagan.

    He said he will wait for authorisation from his force before he publishes the spells online. Supt Simon Hawkins, Hertfordshire's force champion for faith, said: 'While balancing operational needs, the force's religion and beliefs policy gives all staff the choice of re-allocating the traditional Christian bank-holiday festivals to suit their personal faith. 'This has been very well received from a number of faith groups, including Muslim and Jewish.'

    Secret pay deals give top police thousands extra

    The private deals are negotiated with police authorities behind closed doors Senior police officers are receiving “off-book payments” and secret perks totalling hundreds of thousands of pounds, including private school fees and cars for their spouses.

    The Times has discovered that one chief constable heading a force of just 1,700 officers was paid a £74,000 top-up on his salary last year. Sean Price, of the Cleveland force, was paid a £50,000 “retention package” and an “honorarium” of £24,000, raising his income to £200,000. The private deals, sometimes referred to as debentures or supplements, are negotiated with police authorities behind closed doors and paid over and above salaries agreed in national negotiations. The incentives include generous relocation packages, satellite TV, home security and even “lifestyle coaching”. They are legal but largely hidden from the public. The Times has uncovered the scale of the practice.

    Ian McPherson, head of Norfolk police, received £70,000 more than his £126,000 salary in 2007-08 when his police authority paid the stamp duty on his purchase of a new house. Sir Norman Bettison, West Yorkshire’s chief constable, has a “unique package” worth about £55,000 a year. Essex Police Authority paid a “golden handcuffs” bonus to the chief constable, Roger Baker, but the strategy failed because he retired this week.

    The pay deals are the subject of fierce disagreement among chief police officers and officials, who are gathering today in Manchester for the annual conference of the Association of Chief Police Officers (Acpo) and the Association of Police Authorities. Sir Ken Jones, the retiring president of Acpo, said: “If people feel that the pay scales need to change then they should be openly renegotiated. These payments effectively lock people into a particular force and inhibit movement and development.”

    Another senior officer told The Times: “We should not have such secrets in the Police Service. This works totally against the idea of equal opportunities. You have to be part of the inner circle.” But Stephen Bett, the chairman of Norfolk Police Authority, said: “If chief executives of district councils, with very limited direct public accountability, are paid £120,000 a year, what would attract anyone to be Chief Constable of Norfolk, with all his direct accountability, for £129,000 per year?”

    So looking at that Oath I see that it speaks only of “serving the queen in the office of Constable”

    So lets look up the definition of a Constable:

    CONSTABLE - An officer, generally elected by the people, who possesses power as a conservator of the peace at common law, and by virtue of various legislative enactments. He may therefore apprehend a supposed offender without a warrant, as treason, felony, breach of the peace, and for some misdemeanours less than felony, when committed in his view. He may also arrest a supposed offender upon the information of others but he does so at his peril, unless he can show that a felony has been committed by some person, as well as the reasonableness of the suspicion that the party arrested is guilty. He has power to call others to his assistance or he may appoint a deputy to do ministerial acts.

    A constable is also a ministerial officer, bound to obey the warrants and precepts of justices, coroners and sheriffs. Constables are also in some states bound to execute the warrants and process of justices of the peace in civil cases. In England, they have many officers with more or less power, who bear the name of constables; such as, lord high constable of England, high constable, head constables, petty constables, constables of castles, constables of the tower, constables of the fees, constable of the exchequer, constable of the staple, etc.

    In some of the cities of the United States there are officers called high constables, who are the principal police officers where they reside.

    Blimey ... thats interesting! Lets take a closer look at this then ...

    So we see that a “Constable” is “an officer, generally elected by the people”?

    I would love to know if there is common law or old law that confirms that every Police Constable has to be elected by the people, if this is true then it means overnight that every Policeman and Police woman in the land is UNELECTED and therefore is NOT a Constable! Ooh somebody please tell me its true!

    Hot damn – there it is in Black and White that a Constable is responsible primarily for upholding the peace under COMMON LAW. Also take a look at the Attestation published earlier, it says ...

    “I will, to the best of my power, cause the peace to be kept and preserved and prevent all offences against people and property;”

    So even in the Oath the Constable took he confirmed that he himself/ she herself had the job of keeping the peace and preventing offences against people and property, in other words, preventing “Harm or Loss” under common law.

    Also, the definition of Constable goes on to say:-

    “and by virtue of various legislative enactments”

    Well, as we have all learned I am sure, “Statute / Leglislation are merely a set of rules given the FORCE of law by the consent of the governed” So even though the Definition says “by various legislative enactments” those very legislative enactments are impotent unless we give our consent to be governed by them. I certainly don’t!

    You will also notice that the Attestation sworn by Constable says this;-

    “and that while I continue to hold the said office I will, to the best of my skill and knowledge, discharge all the duties thereof faithfully according to law.”

    Its says ... “ACCORDING TO LAW!”

    Statue and legislation is NOT law! Merely a set of rules (not law) given the FORCE of law (same power as if law SUBJECT TO) by the CONSENT (means agreement and recognition of that FORCE of law) of the GOVERNED (by you and without which the FORCE of law does not apply).

    NOWHERE, I Repeat NOWHERE in the Attestation (Oath) of a Constable does it mention or speak of STATUTE or LEGISLATION! Therefore by default no single Police Constable in this land has agreed to uphold Statute / leglislation in their Oath.

    Its interesting that in the USA there are some people now confronting Police officers and putting them on notice of their Oaths the uphold the LAW (Not Statute / Legislation) I have links to videos on Youtube of this happening if you need them. I digress, lets get back to the definition of a Constable where it says;-

    WOW!!!! ... so from what I am reading here is that there is a price to pay if a Constable makes an arrest without being able to show that a felony has been committed along with the reasonableness of the suspicion that the arrested party is guilty. I am now going to start researching the office of Constable in great detail if it means we can hold these Peace officers to account in the event that they try to enforce their corporate statutes upon us in blind disregard to common law.

    Cannot be stopped by police officer unless there is an intention to arrest. Citizens have no duty to answer questions. Rice v Connoly 1966 QB: cannot arrest for refusal to answer questions and no legal duty to accompany police officers. Ergo, next time I get stopped I will let the constable know that I have no legal duty to go with him!

    I feel a lot more reading is required on this subject, the office of Constable is an ancient and honourable office that has been twisted and abused by the Corporate governance machine and its time we took the office back for ourselves.     A 50-year-old woman has been arrested in connection with the killing of a private detective 22 years ago. The woman is being questioned at a south London police station on suspicion of conspiracy to murder 37-year-old Daniel Morgan. Mr Morgan, from Monmouthshire, was found with an axe in his head in a car park in Sydenham, south London in 1987.

    Four men have been charged with his murder and are due to appear at the Old Bailey in July. Mr Morgan's former business partner William John Rees, 53, also known as Jonathan, of Weybridge, Surrey; James Cook, 53, from Tadworth, Surrey; Garry Vian, 47, of no fixed address, and Glenn Vian, 49, of Orchard Road, south Croydon, are all charged with his murder. A fifth man, Sidney Fillery, 61, a former detective sergeant with the Metropolitan Police, has been charged with perverting the course of justice.

    Mr Fillery, now a barman from Great Yarmouth, Norfolk, was initially involved in the investigation but was later on taken off the case. Mr Morgan, who was originally from the village of Llanfrechfa, jointly ran a security firm called Southern Investigations. The father of two's body was found outside the Golden Lion pub on 10 March 1987.

    More than 300 Scotland Yard detectives are being investigated for possible fraudulent use of their corporate credit cards. The figure is revealed in an audit report to be discussed by members of the force watchdog the Metropolitan Police Authority today. Auditors launched an inquiry into detectives' use of the American Express credit cards two years ago after it was found that officers could not properly account for more than £3 million worth of expenses.

    The cards were routinely issued to the 3,500 detectives involved in counter-terrorism and specialist crime investigation who need to claim expenses when working outside of London. Now the internal audit has referred the claims of more than 300 officers to the Met's Directorate of Professional Standards. Only those suspected of overcharging by more than £1,000 have been referred to the DPS. So far, their inquiries have found serious concerns with 46 officers whose cases have, in turn, been referred to the Independent Police Complaints Commission for investigation. Two detectives have been prosecuted and convicted as a result.

    There are claims that one senior officer £40,000 on his Amex card in one year, without authorisation. Items bought by others without permission are said to include suits and fishing rods. MPA member Jenny Jones said: “This raises questions about who was monitoring the spending on these cards and if clear instructions were given to those using them. “It beggars belief that so many officers are suspected of fraud in this way.”

    The audit probe has revealed major past failures in the Met's accountancy procedures and many detectives say the system of checking expenses was almost non-existent so many failed to keep receipts for their spending. However, some officers are accused of using the cards to spend public money on themselves or their families. They are alleged to have used the cards to pay for holidays and Rolex watches. One is said to have used his Met card to pay for his wife's plastic surgery.

    Some of those under investigation include detectives who worked in the north of England on the 7/7 London bombings inquiry. Last month three detectives were arrested for allegedly making “inflated” claims while investigating the bombings. The latest report by Peter Tickner, the head of internal audit at the Metropolitan Police Authority, says his investigators have now finished examining the Amex accounts of all officers.

    His report states: “In excess of 300 police officers have been referred to the Directorate of Professional Standards by my staff and forty-six of these have become formal investigations overseen by the Independent Police Complaints Commission. This has resulted in two prosecutions and convictions but most cases are still under investigation.” The latest claims accuse officers of using their cards and public money on suits, women's clothing and fishing rods. The MPA has now cancelled its contract with American Express in favour of a four-year deal with Barclaycard.

    Under the new scheme officers will have a spending limit of £ 5,000 a year with managers receiving a monthly statement outlining the expenditure incurred by staff issued with the corporate charge card'. The MPA says it has introduced new software checks on the expenses claims involving Barclaycard.

    Metropolitan Police officers subjected suspects to waterboarding, according to allegations at the centre of a major anti-corruption inquiry, The Times has learnt. The torture claims are part of a wide-ranging investigation which also includes accusations that officers fabricated evidence and stole suspects’ property. It has already led to the abandonment of a drug trial and the suspension of several police officers. However, senior policing officials are most alarmed by the claim that officers in Enfield, North London, used the controversial CIA interrogation technique to simulate drowning. Scotland Yard is appointing a new borough commander in Enfield in a move that is being seen as an attempt by Sir Paul Stephenson, the Met Commissioner, to enforce a regime of “intrusive supervision”.

    The waterboarding claims will fuel the debate about police conduct that has raged in the wake of hundreds of public complaints of brutality at the anti-G20 protests in April. The part of the inquiry focusing on alleged police brutality has been taken over by the Independent Police Complaints Commission. It is examining the conduct of six officers connected to drug raids in November in which four men and a woman were arrested at addresses in Enfield and Tottenham. Police said they found a large amount of cannabis and the suspects were charged with importation of a Class C drug. The case was abandoned four months later when the Crown Prosecution Service said it would not have been in the public interest to proceed. It is understood that the trial, by revealing the torture claims, would have compromised the criminal investigation into the six officers.

    None of the officers under suspicion has been arrested, but the IPCC said last night: “This is an ongoing criminal investigation and as such all six officers will be criminally interviewed under caution.” A Scotland Yard spokesman said: “Whilst the investigation is ongoing it is not appropriate to make assumptions. These are serious allegations that raise real concern. The Met does not tolerate conduct which falls below the standards that the public and the many outstanding Met officers and staff expect.”

    A number of police officers are under investigation after allegations that they stole cash or other valuables during an unprecedented police raid on more than 3,000 safe deposit boxes in three security vaults in London last year, The Independent has learnt.

    Scotland Yard's professional standards directorate is investigating nine complaints, include two allegations of theft, against police officers who took part in Operation Rize, the raid on three security vaults beneath some of London's most select neighbourhoods. It was claimed at the time that the operation, in which some officers were heavily armed, had uncovered an "Aladdin's cave" of criminal proceeds worth at least £35m. However Scotland Yard's internal investigation comes amid wider concerns that the raids trampled on the privacy of 2,500 innocent box holders, who include a Holocaust survivor and High Court judges. Each holder of the 3,554 boxes seized last June at the depositories operated by Safe Deposit Centres Ltd has had to prove they legitimately own items and cash found in the boxes, or face a criminal investigation. Lawyers say the raid has set a disturbing precedent for indiscriminate "fishing trips" by police seeking evidence of wrongdoing.

    Detectives from the Yard's Economic and Specialist Crime Directorate insist Rize has been a substantial success, leading to 40 arrests for offences ranging from running prostitution rings, money laundering, drug supply, paedophilia, burglary and benefit fraud. Eleven prosecutions have been brought in connection with this raid, they say. But an investigation by The Independent has revealed that nine complaints have been made against officers who took part in the raid, including two separate claims of theft: it has been alleged that small items of jewellery and £8,500 in cash were removed from boxes. Three claims for compensation arising from damage to property caused by police, understood to total around £5,000, are also being processed. The Independent understands that among the unwitting box-holders caught up in Rize was a Jewish man who survived the Holocaust as a child. He kept a lump sum in case his family ever needed to flee their home once more. A father whose daughter was killed in a car accident had placed the cash compensation he received in a security box because he did not know what to do with it. Another family was using a box to store money that a relative with a gambling addiction had "paid back" after years of theft.

    Several High Court judges and senior police officers, as well as a well-known businessman and a scion of an international banking family were also clients of Safe Deposit Centres. Some of the boxes held highly personal possessions, such as photographs and details of second families. The contents of about 2,500 boxes have now been returned to customers while around 700, containing up to £15m in cash, have been passed to HM Revenue and Customs to be investigated for tax evasion. Cash has only been returned after owners were able to provide documents proving its source and that any taxes due on the sum have been paid. When Roger Mortlock, 59, had his box returned to him after an exhaustive verification process for the £110,000 he had stored, he said it contained £8,500 less than it had the last time he counted the cash.

    Mr Mortlock, who is being treated for cancer, said: "I got the box because we had been burgled twice. Having a box doesn't make you a criminal. "I couldn't believe the way I was treated. I felt as if I was guilty until I had proved myself innocent. It took months to even get to the stage where I was allowed to retrieve my belongings, and then I found that a substantial amount of the money had gone missing." Jeffrey Lewis, senior partner of law firm Lewis Nedas, which has represented more than 70 box-holders, said: "If police want to search a flat rented by a drugs dealer in a block of flats, they would ordinarily be granted a warrant to search the flat used by that particular suspect. In this case, they have in effect smashed their way into every flat on no real credible basis."

    Lawrence Kelly, partner at Lawrence Stephens Solicitors, which has also represented box-holders, said: "What police seem to have achieved is to search and seize first, and then place the onus on the individual to prove they have acted lawfully." Detectives leading Operation Rize said they had reason to believe a "high percentage" of the boxes were being used by criminal gangs. They admitted "innocent" box-holders had been inconvenienced by the investigation but underlined that the operation had scored significant success in targeting serious criminals. A Metropolitan Police spokesman said: "A priority for the investigation has been to ensure that where contents are held legitimately, the owners have the contents returned to them as soon as possible."

    We had a fantastic official start to our campaign this week. Around 150 people gathered for the launch meeting of United Campaign Against Police Violence in London on Tuesday. The rally heard from Green Party member of the London Assembly, Jenny Jones, Anna Fairclough from Liberty, Sam Rigg-David from Sean Rigg Justice and Change Campaign, Deborah Coles of Inquest, Andrew Burgin from Stop the War, Martin Smith from the SWP and Andy from Legal Defence & Monitoring Group. We were also privileged to hear from family members of both Roger Sylvester and Habib 'Paps' Ullah - both of whom died in the custody of police. It was announced at the meeting that our forthcoming demonstration on Saturday 23 May will march from Trafalgar Square to New Scotland Yard, via Downing Street.     The campaign is now well and truly on the road, so now we need to go all out to build the demonstration. We also decided that Thursdays would be devoted to building the demonstration - leafleting local tube stations and railway stations at rush hour. There is a huge amount of anger in society at the moment - over the death of innocent bystander Ian Tomlinson at the G20 protests, the huge number of people hurt and arrested following the Gaza demonstrations earlier in the year, the continual attacks on civil liberties and the attacks on the right to protest.     The Metropolitan Police today sent out a press release saying that six more people have been arrested over the Gaza protests in December/January. This takes the total number of arrests to 93. The press release states that this relates to "a series of demonstrations in central London descended into violence, with attacks on police officers and a number of shop windows being smashed".

    What the police "forget" to mention is the sheer scale of repression on those wanting to take to the streets peacefully over the attacks on Gaza by Israel. For example, those marching to the Israeli Embassy were "kettled" (in effect, detained without trial) in the Hyde Park underpass, having been directed there by police. There followed a series of baton-charges and panic which, amazingly, did not lead to any serious injuries or deaths. Other reports indicate general levels of verbal and physical abuse by police officers, the penning in of groups of protestors for prolonged periods, and intimidation of press photographers. If the police wanted a violent confrontation they certainly went out of their way to ensure it.

    COPPER SNIPER A man shot dead by police in a quiet country village was depressed at the thought of his sick wife being placed in a nursing home, a close friend said. An officer stands outside Ash Grove in Fernhurst, West Sussex, where a man was shot dead.

    The man, named locally as Mervyn Tussler, was fatally shot following a three-hour stand-off with police in the village of Fernhurst, near Midhurst, West Sussex. Armed response vehicles and police dog handlers went to the area after a woman reported seeing a man with a gun in Ash Grove, a sheltered retirement complex run by Hanover Property Management, where Mr Tussler lived.

    Mr Tussler, in his 60s, had been told by social services that his ill wife Winifred would have to go into a nursing home, according to his friend, Peter Goodman. Mr Tussler had been his wife's carer for the past 15 years and was said to be "lost without her".Mr Goodman, 54, a plumber, said Mrs Tussler had spent around the past four weeks in Guildford Hospital, Surrey, suffering from a urinary infection.

    In the past week, Mr Tussler was told that she was not well enough to return to their home in the retirement block in Ash Grove, Mr Goodman said. "He just seemed to be depressed about Win being in hospital," said Mr Goodman. Mr Goodman said the couple, who had two grown-up children, were extremely close.

    Large quantities of cash were found in the man's house A man has been ordered to forfeit more than £67,000 because he could not prove where the money came from. Police found the cash at his house in Sandfields, Port Talbot, after reports of an attempted burglary there.

    He was arrested on suspicion of money laundering and although never charged police have successfully applied to the courts for a confiscation order. The man, who has not been named, said he saved up some of the money and made the rest selling military memorabilia.

    But police instigated proceedings under the Proceeds of Crime Act (POCA) as he could not provide any legitimate source for the money. A forfeiture hearing was held at Neath Magistrates Court on Friday.

    Police said checks were made with HM Revenue and Customs, the Department for Work and Pensions and Neath Port Talbot council which further proved the cash was not earned legitimately. Det Con Phil Davies, financial investigator for the division, said: "The onus was on the respondent to provide a lawful origin of the cash found in his possession. "A legitimate source was not found and the cash was subsequently forfeited.

    "It is enough to show that the cash is probably related to one of a number of kinds of activity, any one of which would have been unlawful, for example, cheating the revenue, trading in counterfeit goods, drug supply or falsely claiming state benefits." "The public can really help us by passing on any information about people who may be making a living off ill-gotten gains. "Generally, these people are clearly seen to spend more than their apparent disposable income. This can include owning properties, expensive cars or having a social lifestyle beyond their means."

    Rogue company to help set code on fair parking

    A rogue clamping company that overcharges drivers and rejects legitimate appeals has been appointed to a Government-backed body that aims to ensure fairness in parking enforcement. Parking Control Management (PCM) is one of a group of companies entrusted with creating and enforcing a new code of conduct for the parking industry. Yet it has repeatedly breached the existing code by double-charging drivers. It forced an elderly couple to pay £375 to retrieve their car after they had parked on the forecourt of a boarded-up office for 30 minutes. The Home Office will claim today that it is taking action against unfair clamping on private land by requiring all parking companies to be licensed and to adhere to an approved industry code. But an investigation by The Times has revealed that the only existing code is already being breached repeatedly by companies that have agreed to abide by it.

    It was created by the British Parking Association (BPA), which the Government recognises as the industry’s only approved trade body. The association has investigated 640 complaints against its members in the past year and identified 58 breaches of its code. But in no case has it taken disciplinary action against a member, even after multiple breaches of rules on sign visibility and the amount that can be charged for clamping and removal. The AA said that the code was too weak and that the BPA was a toothless body that could not be trusted to regulate its members. Edmund King, the AA president, said: “We are very concerned that the Government may be outsourcing to the BPA the responsibility for protecting motorists from rogue clampers. The BPA has failed to hold its members to account for breaching the code. It appears more concerned with protecting the profits of its members than ensuring justice.”

    Mr King said that motorists ticketed or clamped on private land should have the same right of appeal to an independent body as drivers who were fined for parking offences on public roads. The Traffic Penalty Tribunal, which hears appeals against tickets issued on public roads, said yesterday that it had ruled in favour of the driver in 60 per cent of cases last year. The Times alerted the BPA five weeks ago to the case of the elderly couple double-charged by PCM in Maidenhead in January in a breach of the code. This states that if a vehicle is removed within three hours of clamping, the driver should pay only the removal fee, not the clamp-release fee. PCM charged Mavis and Brian Maynard, aged 73 and 77, a removal fee of £200, a release fee of £130, a storage fee of £40 even though the car was retrieved two hours later, and a credit card fee of £5. It rejected two internal appeals by the Maynards.

    Martin Halstead was also double-charged by the company in Maidenhead. He paid a release fee of £130 and a removal fee of £200 even though his car was not removed. PCM tried to justify the latter fee by claiming that a removal truck had been called. The company refunded £240 after Mr Halstead began legal proceedings. He wrote to the BPA six weeks ago asking it to investigate eight apparent breaches of the code by the clamping company. The BPA has yet to respond. Patrick Troy, chief executive of the BPA, said that a member of staff would be visiting PCM to check that it was complying with the code. He said the BPA preferred to work with member companies and give them the chance to change their practices rather than fining or expelling them. Last week the BPA appointed David Blake, head of PCM, to a board given the job of “achieving greater fairness within unregulated parking on private land”.

    Police 'pay protester informers'

    Police are using hundreds of paid informants inside protest groups to "feed them intelligence", according to evidence handed to the Guardian. The paper says it has obtained tapes of discussions between men claiming to be undercover officers from Strathclyde Police and a Plane Stupid activist. The recordings appear to show money being offered for information.

    Strathclyde Police said officers had spoken to the group and the force had a responsibility to gather evidence. The Guardian says the recordings were made during meetings between Strathclyde Police and Matilda Gifford, an activist with environmental protest group Plane Stupid, which campaigns against airport expansion. The taped evidence appears to show her being offered money to reveal information about the organisation's members and tactics.

    'Respecting rights'

    An indication was given that tens of thousands of pounds had been paid to other informers in the past. Miss Gifford's student loans were also discussed. In the three hours of recordings, the unnamed men also claimed to have a network of hundreds of informants inside protest organisations across the political spectrum. The Assistant Chief Constable of Strathclyde Police, George Hamilton, told the Guardian the force had "a responsibility to gather intelligence".

    "Officers from Strathclyde Police have been in contact with a number of protesters who were involved with the Plane Stupid protests including Aberdeen airport," he said. "The purpose of this contact has been to ensure that any future protest activity is carried out within the law and in a manner which respects the rights of all concerned."

    'Business proposal'

    But Miss Gifford said police were trying to disrupt the legitimate activity of environmental groups. She told the BBC that while payment was discussed, definite sums of money were never finalised. "They never said an actual amount to me," she said.

    "They wanted to discuss a business proposal in our next meeting, is what they said, so we never actually put a figure on it. "They hinted it would be useful in terms of student loans."

    Miss Gifford also said that Plane Stupid's lawyers had attempted to identify the officers involved, but without success. Former Flying Squad chief John O'Connor described the matter as a "storm in a teacup" and that similar contacts are often made with individuals in protest groups and in the criminal world. He told the BBC: "That's what the police do. The police don't sit in their ivory towers, and expect the phone to ring and be given intelligence information. "They go out actively to try and gather it."

    COP THUGS It was not many years ago when I considered myself a supporter of "law enforcement." (I made donations, had the F.O.P. and Sheriff's department stickers and everything.) Cops were, I believed, the good guys, protecting the innocent and imposing justice upon evildoers. Oh sure, I knew there was corruption here and there, and scattered examples of police abuse--a few "bad apples" in the ranks- - -but all in all, I thought the cops were the good guys.

    Now I'm really darn embarrassed that I ever thought that.

    This will be the first in a series of messages where we examine the question, are the American "law enforcers" of today noble public servants, or despicable fascist pigs?

    First, we must define our terms. For example, someone having a short temper, or exercising bad judgment, even repeatedly, is not necessarily a fascist pig. No, a cop's level of "fascismo," if you will, must be measured by something other than just being stupid or even malicious. To truly be a fascist, a cop must demonstrate that he has the fascist mindset. So let's define what that is.

    A NON-fascist cop, when he looks out at the world, would see lots of good people, whom he would want to protect, and would never want to harm, intimidate, or even inconvenience unnecessarily. His goal would be to find the nasty people in the world, and see to it that they are prevented from harming any of the decent people.

    A FASCIST cop, on the other hand, would view everyone as his inferior, to be controlled, interrogated, or even abused at will. He sees himself, a representative of "authority," as having the right to forcibly impose his will on anyone he wants, whenever he wants, for any reason (or no reason) and the right to use outright violence against any who do not obey his every whim.

    So, in this message and the ones to follow, we will examine examples of police conduct in this country, and rate the level of "fascismo" demonstrated by American "law enforcement." What we won't bother looking at are things like a car chase which ends with a cop with too much adrenaline in his blood, or a cop shooting someone with somewhat questionable justification. No, we are looking for ATTITUDE. The goal is to determine if American cops today think like defenders of justice, or like fascist pigs.

    As you may know, the feds now do internal "checkpoints," anywhere they want within a hundred miles of the border. If you haven't yet heard of this Orwellian absurdity, here are the basics:

    (Yes, I know the ACLU is very selective about which rights it cares about. It fights hard to defend the First Amendment, while fighting hard to VIOLATE the Second Amendment. But their site gives a good summary of the "Constitution free zones.")

    With the "checkpoint" information in mind, here is the specific incident we're considering this time, with our "fascistometers" at the ready:

    Once you've watched the entire video ABOVE "PASTOR BEATEN AND TAZED BY BORDER PATROL" (it's less than nine minutes), consider a few things:

    1) First of all, would anyone who is NOT a fascist pig take part in these warrantless, suspicionless searches at all? Well, no. To think you have the right to stop and interrogate anyone who happens to drive down a road, and the right to search through his stuff, is a classic symptom of being a fascist pig.

    2) Would anyone who is NOT a fascist pig view someone's reliance on his Fourth Amendment rights (to not be subjected to an unreasonable and unjustified search) as a REASON to search his car? Put another way, would anyone who is NOT a fascist pig think that someone must be a criminal if he doesn't want to volunteer to let some jackboot rummage through his stuff? No. Again, this is a classic symptom of someone with a fascist pig world view. (Note that in the clip, the guy describes how the fascist pigs at one point admitted that everything the guy went through was because he wouldn't answer a question.)

    3) Would anyone who is NOT a fascist pig FAKE "probable cause" in order to get around that pesky Fourth Amendment? No. They had no reason to suspect anything--to stop him at all, or to search him after the stop--and then they LIED about it to make up an excuse to do a search. Classic fascist pig behavior.

    4) Would anyone who is NOT a fascist pig smash someone's car windows, taser him, and forcibly extract him from his car, without ANY "probable cause" to think the person had committed a crime? Again, no. (If you're finding these questions difficult to answer, please move to Cuba.)

    5) Would anyone who is NOT a fascist pig grind someone's face into broken glass, throw him to the ground, stomp on his head, and otherwise assault him, when the person is unarmed and not resisting, and when there is still no evidence that the guy had committed any crime? No. (The clip doesn't say whether the cops ever knew that the guy is a pastor.)

    6) Would anyone who is NOT a fascist pig openly delight in someone else's misery and suffering, while the person is handcuffed and bleeding profusely, mocking and insulting the guy, when there was still NO EVIDENCE that the guy had committed any crime? No. (I could make another item about not letting the guy go to the bathroom, but I'm trying to keep this relatively short.)

    7) Here's an important one: Would anyone who is NOT a fascist pig QUIETLY STAND BY while his fellow "officers" did what is described above? NO. If this was a case of one or two "bad apples" in law enforcement, wouldn't some other cop there have tried to stop it, or at least complained about it afterwards? So how often have you ever seen that? Where are the "good cops" speaking out about this stuff?

    8) Would anyone who is NOT a fascist pig want to proceed to prosecute the VICTIM of all the abuse I described above, despite the fact that there is STILL no evidence that he committed a crime? No.

    Okay, so what's the verdict for this example? Well, if the story above is an accurate reflection of what "law enforcement" in this country is like today, then American cops are indeed fascist pigs, who deserve our utmost contempt and condemnation. (And if it is NOT an accurate reflection of the attitudes and behavior of the police in this country, where are the GOOD cops speaking out against this?)

    In closing, I'd like to say the following to Mr. C. Diaz, Mr. B. Griffiths, and Mr. E. Gomez, and any other Nazi swine who participated in the incident described above. If some day you pick the wrong target for your Gestapo crap, and the guy blows your damn fascist pig heads off, the world will be a better place.

    A second post-mortem examination has sensationally revealed that the newspaper seller hit by a policeman at the recent G20 protests died from internal bleeding, and not a heart attack as previously thought. Ian Tomlinson died minutes after the incident involving a Territorial Support Group officer from the Metropolitan Police, which was captured on video.

    In light of today's development, the officer has now been questioned under caution for manslaughter, the Independent Police Complaints Commission said today. The first post mortem was carried out within two days of the incident, at the beginning of this month, and the cause of death was originally established as a heart attack.

    POLICE TO SHARE £5M CRIMINAL? ASSETS

    More than £5 million of assets seized from criminals is to be handed to police across England and Wales. A total of £31.8 million in criminal assets was confiscated between October and December last year. Half is to be shared between police, prosecutors, courts and other bodies, the Home Office said.

    The amount to be given to English and Welsh police forces is £5.5 million, up from £5.14 million in the same quarter in 2008. The rest of the £15.9 million will be shared out among HM Revenue and Customs, the Serious Organised Crime Agency, the Crown Prosecution Service, the courts service and other local authorities. Since 2003, when the Proceeds of Crime Act came into effect, £530.5 million has been seized, with over £135 million recovered in the financial year 2007-2008.

    Under an incentive scheme introduced in 2006, police and recovery agencies can retain half of the cash they confiscate from criminals. Home Office Minister Vernon Coaker said: "This scheme is a great benefit for policing. Taking money from criminals makes crime far less profitable for them. "At the same time, that money is ploughed directly back into the police force that seized it so they can use for their fight against crime in their area.

    "Recovering more than £31 million from criminals in the space of three months is a great achievement and I want to thank the police and other partners for their hard work in seizing the money and undermining criminal gangs

    Police round up 114 eco-protest suspects ahead of power plant demo

    More than 100 people were arrested today for allegedly planning a protest at a coal-fired power station. Police officers who raided an independent school in Sneinton, Nottingham, said the protesters would have posed 'a serious threat' to the safe running of Ratcliffe-On-Soar power station.

    A spokesman for Nottinghamshire Police said 'specialist equipment' recovered during the raid led them to believe the power station was the intended target.

    The Metropolitan Police has been ordered to review the crowd control tactic known as the “kettle” that was used to pen in 5,000 people protesting at the G20 summit in London last week. Senior Scotland Yard officers who led Operation Glencoe, designed to prevent disorder in the capital during the summit, have been summoned to explain their tactics to members of the force’s watchdog body, The Times has learnt.

    Commander Bob Broadhurst and his team will also be questioned at a closed meeting of the Metropolitan Police Authority about the death of Ian Tomlinson, who was hit by a riot police officer minutes before he died from a heart attack. Mr Broadhurst, who gave stark warnings of violence ahead of the protests, will face questions about whether the language he and fellow commanders used increased the possibility of confrontation with demonstrators.

    brigham Former Pc jailed over boy abuse

    A former police officer has been jailed for two-and-a-half years after admitting four counts of sexual activity with a 15-year-old boy. Mark Brigham was serving with the Metropolitan Police when the incident took place in Portsmouth, in 2008. The victim's family asked Brigham, a lesbian and gay liaison officer, for advice after their son came out as homosexual, the court heard. The 38-year-old, from Hackney, east London, had resigned from the force. He had been suspended pending the case.

    Portsmouth Crown Court was told that Brigham, a police constable for nine years, had attended a party last August where he befriended the boy. The off-duty officer had been asked to talk with the boy to offer advice.

    But, the court heard, they performed consensual sex acts on each other. Matthew Lawson, prosecuting, said that Brigham had described his victim as "stunning" to other people at the party during the evening but had been informed that the boy was only 15-years-old. He added that after the party, Brigham kept in contact with the boy through text messages and through the Facebook internet site. The boy later told his family what had happened.

    The hearing was told that Brigham had been going through a number of personal issues at the time including the break up of a relationship and had large debts. Sentencing Brigham, Judge Roger Hetherington, said: "The offences are aggravated by the disparity of age between the two of you - you were more than twice his age. "You were someone he could expect to look up to and expect some guidance from." Brigham was jailed, ordered to sign on the sex offenders register for an indefinite period and banned from working with children. Speaking after the hearing, Det Con Dave Anderson, of Hampshire police, said: "It's a sad end to an officer's career but also it will give some finalisation for the victim."

    Pc Steve Bettley, of Merseyside Police, was included in the list of the far right party's entire membership register which was leaked on an internet blog. The officer, who was briefly the driver for chief constable Bernard Hogan Howe, has been suspended from duty since the list became public last November. A Merseyside Police spokeswoman said: "A Merseyside Police misconduct panel has dismissed Constable Steve Bettley after concluding he had knowingly been a member of the British National Party from March 2007 and up to March 2008."

    The spokeswoman added: "In determining their findings, the panel confirmed there was no evidence that Pc Bettley had ever displayed any racist views or discriminatory behaviour in the workplace. "The panel determined that Pc Bettley's membership of the BNP is a clear breach of lawful orders and police regulations as the party's views are incompatible with the duties and values of the Police Service." A ban on serving police officers joining the BNP was introduced by the Association of Chief Police Officers (Acpo) in 2004.

    Merseyside Police Federation, which represented Pc Bettley at the misconduct hearings, said he accepted his name was on the BNP list but he denied being a member of the party. He said he was enrolled in the party by a family member without his knowledge and he planned to appeal against the dismissal. A spokesman for Merseyside Police Federation said: "We are disappointed with the finding and sanction of the misconduct panel and do not believe that there is any evidence presented to the panel which would indicate that he was knowingly a member of the BNP."

    5. Fred and Mary West mass murderers who buried their victims in their house and garden. West was regularly on the cops radar but did nothing and allegations that cops used his home as a brothel.

    6. John Worboys black cab driver who raped 100's of women yet despite repeated reports the cops did nothing.

    There are many other gangsters and crooks running free thanks to the utter failure of cops with an agenda .

    FOUR police officers are being probed over claims they helped a landlord throw out a mum and her two kids. Geraldine Downes, 45, called police after 15 men arrived to change locks on the rented house the day after a deal to buy it fell through.
    But she says they stood by as she was illegally evicted by owner Jane Thomson even though there was two weeks left on the lease for the property in Newmilns, Ayrshire and no eviction order. She and James, eight, and five-year-old Kim were left homeless. She said: "One of the officers called his sergeant who said Thomson was entitled to remove me."

    The inspector, sergeant and two PCs now face an internal probe. Dog breeder Thomson refused to comment.
    Strathclyde Police said: "We are investigating."

    Figures expose police convictions
    Forces should get tough on "bad apples", say the Lib Dems.

    More than 1,000 serving police officers in Britain have criminal convictions, according to figures obtained under the Freedom of Information Act. More than half of the 1,063 convictions relate to speeding or other motoring offences, 77 officers have convictions for violence and 96 for dishonesty. The Liberal Democrats, who obtained information from 41 forces, called the figures "staggering".

    Police chiefs said each case was assessed on its merits.

    The figures cover only those forces in England, Scotland and Wales which responded. The Police Service of Northern Ireland refused to answer the Lib Dems' request for information. Most recent figures put the number of serving officers in the 51 territorial forces in England, Scotland and Wales at 159,359. This figure does not include the British Transport Police, Ministry of Defence Police and Civil Nuclear Constabulary.

    Serving officers who are convicted do not face automatic dismissal, but the Association of Chief Police Officers said it was "very rare" for people with convictions to be recruited by the police. The number of serving officers with convictions includes five who were sacked but then reinstated by the Home Office. Among others to escape losing their job was a West Midlands Police officer who was convicted of kerb crawling.

    Keep jobs

    The figures also show that forces serving Durham, Surrey, Dorset, Greater Manchester, Lothian and Borders, and Grampian had a total of 132 serving officers with convictions none was dismissed. Offences included a serious assault in Durham, four incidents of drug possession in Surrey and two incidents of misconduct in office in Manchester. The total figure for Britain, which does not include cautions, is likely to be higher because some forces did not provide full details and 10 gave no information at all, said BBC home affairs correspondent Danny Shaw.

    Chris Huhne: A few bad apples shouldn't be allowed to bring the force into disrepute

    The figures showed 210 officers had been dismissed or required to resign in the past five years as a result of criminal convictions. Of those with convictions for violent offences such as assault, battery and wounding, 77 had kept their jobs, and 45 had been dismissed in the last five years. There are 96 serving police officers with convictions for offences of dishonesty, including theft, perverting the course of justice, fraud and forgery.

    'Bad apples'

    Liberal Democrat spokesman Chris Huhne said it was "worrying" that so many police officers with serious convictions had been allowed to keep their jobs. "It is staggering that so many of the people entrusted to protect us from crime have criminal convictions themselves," he said.

    "The public entrust the police with the use of legal force precisely because they are self-disciplined and restrained, which is why anyone convicted of a violent offence should be dismissed." He added that those convicted of dishonesty could not perform their duties effectively, as they could not be relied upon as a witness. "Police forces should get tough on bad apples," he added.

    The 43 English and Welsh police forces are the most expensive in the world and are in need of dramatic change, the think tank Reform has said. It says they are run as inefficient and costly fiefdoms accountable only to weak police authorities.

    And three years after plans for merged "superforces" were dropped, it suggests there should be more, smaller forces. The Home Office said it made no apology for record investments which had helped cut crime by over a third in 12 years. The Reform report said that if the forces do not change their structures, they risked losing the battle against rapidly changing crime. 'Oligarchy'

    It said Scotland Yard should co-ordinate the national fight against serious and organised crime in the same way as it dealt with terrorism. Many regional forces should be split into smaller units, creating up to 52 more constabularies, because they are too big to be effective, the report added. This suggestion comes just three years after the government abandoned plans to merge many of the existing forces to create just 17 large "superforces".

    Reform's deputy director, Elizabeth Truss, said: "The threat of crime is changing and growing but the police response has been hampered by the obsolete structure of 43 regional forces. "England and Wales need a national lead force on serious crime such as gun crime, drugs and people trafficking. "The Serious Organised Crime Agency (Soca) is the wrong answer to the right question. The Metropolitan Police is the de facto national force and needs to be formally responsible.

    "Data shows small police forces catch more criminals than larger ones. The current 43 forces should be split into a total of around 95 so police forces can properly reflect their local communities." The report, called A New Force, said the cost of policing had increased by more than £4.5bn since Labour came to power in 1997. The Association of Chief Police Officers (Acpo) was a "self-perpetuating oligarchy" of senior police officers, it added.

    A Home Office spokesman said: "The 60% increase in funding since 1997/8 combined with historically high numbers of police officers, staff and police community support officers has helped deliver very real benefits. "Crime has fallen by over a third in the last 12 years and the risk of being a victim of crime is historically low. "We are building on these successes by slashing red tape to get more officers on the beat, scrapping all top down targets except one - to increase public confidence, and making sure the police answer to the public, not government."

    Sir Norman Bettison, representing Acpo, said the report was based on opinion rather than evidence but did highlight some key issues. Sir Norman, who is the chief constable of West Yorkshire, said: "Serious organised crime is not an abstract phenomenon. The drugs are dealt, firearms used and acquisitive crime committed in local neighbourhoods. "The perpetrators and their violence plague local communities.

    "There is therefore a benefit to a single structure, able to build intelligence and the means to tackle criminality at neighbourhood, force, regional and national level."

    Police get half of criminals’ cash

    SCOTS police will be able to keep up to half of the assets seized from criminals under a new incentive plan. Forces are looking to introduce a scheme similar to that south of the border, which means police and other agencies receive 50% of what they recover. Ministers are thought to back the move. Currently, the money is collated nationally and a proportion of it is awarded to local community and sports projects.

    Strathclyde Police has been looking at how the scheme could be implemented in Scotland. The Crown Office has seized more than £25million under the Proceeds of Crime Act since 2003. Last year Scotland's biggest confiscation order of £1.3m was made against Michael Voudouri, 37, of Bridge of Allan, who was jailed for four years in 2004 for a £3m VAT scam.

    However, some senior police are concerned that on average just 10% of the assets they believe are held by criminals are ultimately confiscated. One senior officer said: "There is a real frustration that once we have identified 100% of their assets, the balance sheet goes forward for negotiation with the defence and, after that bartering process, on average we are seeing just 10% taken off people. "We have got to look at the system again. Currently, there are other pieces of legislation, like the matrimonial homes act, which immediately splits the property 50/50, cutting the amount in half."

    Gordon Meldrum, director-general of the Scottish Crime and Drug Enforcement Agency said: "I would support incentivisation and I welcome the debate around this. "We are re-doubling our own efforts to tackle this within SCDEA. It is about how we strengthen our challenge to organised crime groups and part of that is the motivation to bankrupt these groups." Forthcoming changes to legislation - including extending the time over which money can be reclaimed from six to 25 years - should help. A Scottish Government spokesman said: "The Criminal Justice and Licensing bill will make it easier to target those who direct crime or those who turn a blind eye to it and those who live off it."

    How can an organisation that is not subject to public scrutiny set up a sinister unit to monitor political and environmental groups?

    "A secret police intelligence unit has been set up to spy on leftwing and rightwing political groups," said the story in the Mail on Sunday. Who has decided that political and environmental groups consisting of individuals, who are guaranteed the rights of demonstration, association, free speech and privacy under the Human Rights Act, should be spied upon by this new sinister police unit? The answer is the Association of Chief Police Officers – and that is the problem. Few understand that ACPO is a private company, which happens to be funded by a Home Office grant and money from 44 police authorities. But despite its important role in drafting and implementing policies that affect the fundamental freedoms of this country, ACPO is protected from freedom of information requests and its proceedings remain largely hidden from public view. In reality ACPO is no more troubled by public scrutiny than the FREEMASONS.

    That is wrong. Senior police officers are acting with increasing autonomy in drafting these authoritarian new policies. If you wonder how it came to be that police officers are being equipped with 10,000 stun guns, despite the reports of hundreds of deaths in the United States, or how the automatic number plate recognition camera network was set up to record and store data from most road journeys, look no further than ACPO.

    Too often it seems ACPO is the driving force behind policy, and the Home Office succumbs, either because of its own autocratic instincts or because the police are exceptionally good at pushing through the things they want. Now the police have set up the confidential intelligence unit to monitor the political life of this nation. The only reason we know of this is because the Mail on Sunday followed up an internal police job advertisement for the head of the confidential intelligence unit, who would work closely with government departments, university authorities and private sector companies "to remove the threat of criminality and public disorder that arises from domestic extremism". The story tells us that the CIU will also prevent details of its operations being made public.

    This surely must ring a few alarm bells, even among our complacent MPs who have allowed this tiny state-within-a-state to flourish over the past decade. It is evident that the CIU will not be troubled by any public accountability and that the individual who becomes its head will be able to make decisions unilaterally about the nation's politics. If all environmental groups are to be branded extreme, if those who demonstrate against the invasion of Gaza are, as a matter of course, to be regarded as a criminal threat, we will enter a period of enormous tension between the authorities and those people who wish to exercise their legitimate right to demonstrate. Of course there are extremist groups hoping to make use of troubles ahead but it is surely a matter of the gravest urgency that parliament involves itself in defining the limits of the CIU's activity and bringing ACPO into the 21st century by forcing it to become more accountable and open. We cannot have the police making decisions about what constitutes legitimate politics in this country.

    Masonic snipers No police officers will be prosecuted over the death of Jean Charles de Menezes, Crown prosecutors Service say. It follows a review of new evidence which came to light at his inquest.

    Mr de Menezes, 27, was shot dead by police at Stockwell Tube station in south London after he was mistaken for one of the failed 21 July 2005 bombers. A spokeswoman for the Justice 4 Jean campaign said she was "absolutely furious" but the family is dropping its legal challenges to the inquest.

    In December, an inquest jury returned an open verdict - rejecting the police view that he was killed lawfully. Stephen O'Doherty, the lawyer who led the CPS review, said: "I have now concluded that there is insufficient evidence that any offence was committed by any individual officers in relation to the tragic death of Mr de Menezes."

    'Inconsistencies'

    The officers, known as Charlie 2 and Charlie 12, told the inquest they had shouted a warning at Mr de Menezes and he had continued moving towards them. But passengers at the inquest had said this was not the case, and the jury did not accept the officers' accounts. Mr O'Doherty said: "Although there were some inconsistencies in what the officers said at the inquest, there were also inconsistencies in what passengers had said.

    "I concluded that in the confusion of what occurred on the day, a jury could not be sure that any officer had deliberately given a false account of events." It's unbelievable that the CPS had taken this decision without talking to the family or their representatives
