Cops say 'cops' did not protect BBC's predatory paedo Savile (masons protecting their own)
Jimmy Savile 'not protected' from arrest, West Yorkshire Police say

A West Yorkshire Police report has found "no evidence" Jimmy Savile was protected from arrest or prosecution by his relationship with the force. But it highlighted an "over-reliance on personal friendships" between Savile and some officers, and said "mistakes were made" in handling intelligence. The force's assistant chief constable admitted "we did fail victims".

Hundreds of allegations of abuse by the former BBC entertainer emerged after his death in October 2011. Speaking after publication of the report, Assistant Chief Constable Ingrid Lee said: "They didn't know, the people engaged with Jimmy Savile, that actually there were these allegations against him. That's what our investigations found out," she said. "There clearly was information available that we should have tied together and we did fail victims in relation to tying that evidence together and we should have done. "If he were alive today, there's absolutely no doubt that he would have had a number of questions to answer."

The police said the report would be passed to the Independent Police Complaints Commission. The West Yorkshire Police review, named Operation Newgreen, comes after a report by Her Majesty's Inspectorate of Constabulary (HMIC) highlighted failings by police forces across Britain. Ingrid Lee Assistant Chief Constable Ingrid Lee said the force failed Savile's victims

West Yorkshire Police (WYP) said there were "currently 76 crimes involving 68 victims committed in the West Yorkshire area relating to Savile", but claimed none of these were reported to the force before his death. The youngest of these victims was five years old at the time and eight others were aged nine or under. The WYP report reveals Savile was used to front a number of the force's campaigns, including one called Talking Signs, where a recording of his voice was broadcast from lamp posts offering crime prevention advice. The report stressed that at the time he was "seen by most of the public as a man who did good work".

It concluded there were concerns about "the over-reliance on personal friendships that developed between Savile and some officers over a number of years". "He (Savile) was able to manage his public persona in such a way that he deceived most people he met. He was a manipulative man who exploited to the worst possible degree the trust people placed in him.

The report raises as many questions as it answers.

How can it be that West Yorkshire police have no record of any allegations against Jimmy Savile while he was alive but have since received dozens of complaints of historical abuse? Why was the 1998 "anonymous letter" claiming the presenter was a paedophile not entered on the force's database and acted upon? And how deeply did Savile's friendships with police officers really go?

Then there are the mysterious links to the Yorkshire Ripper inquiry: the presenter's details were on four "index cards". Perhaps a detective suspected he might be involved. There's no evidence for this - but it adds to an uneasy sense that the review hasn't established the full story of Jimmy Savile's relationships with the force.


"This is little consolation to his victims and WYP accept there are lessons that must be learned and implemented quickly."

'No checks made'

Part of the investigation looked at the disgraced broadcaster's "Friday Morning Club", after reports that officers regularly attended his flat in Leeds while on duty. The report said: "In spite of the rumour and speculation surrounding this meeting, no evidence has been found of any police impropriety or misconduct." The HMIC report published in March said police forces mishandled complaints and missed opportunities to apprehend Savile, and highlighted failures of forces to share information with one another.

In 2007, Surrey Police asked the West Yorkshire force to check what records it held relating to Savile in connection with its investigation at Duncroft School and an inquiry into suspected offences dating back to 1964. The latest report said that even after it had received this request, "WYP continued to use him as part of local crime prevention campaigns. "The reason for this was that the information was not shared across departments, there was no recognition of the impact of this information and no checks were made on intelligence systems in securing Savile's services."

The review also examined suggestions Savile was a "person of interest" in the Yorkshire Ripper inquiry in the 1970s. Although they found thousands of record cards with information about men who had been spoken to it also found many records had since been destroyed. Jon Christopher, West Yorkshire Police Federation: "If there's nothing recorded anywhere, it's extremely difficult to prove otherwise"

The report insists: "They contain scant information and do not indicate whether Savile was a 'person of interest' to the inquiry team. "The information held was his name, date of birth, home address and various reference numbers. It was not possible to establish the relevance of the reference numbers as a large proportion of the investigation paperwork had been destroyed in the 1980s." But the review said: "One card does make reference to Savile offering his services as an intermediary for the police, should the 'Ripper' wish to make contact."

As a result of the WYP review, a separate inquiry will take place into reports that the Leeds Vice Squad had looked into allegations of indecent assault by Savile on two girls in the 1980s. The force said there was no record of an investigation taking place, but have referred the matter to the IPCC as "the information has come from a retired police officer who was clear in his assertion that an investigation was conducted into Savile".

'Mistakes were made'

A separate IPCC referral relates to an anonymous letter sent to Scotland Yard in 1998, which was forwarded to West Yorkshire Police. It claimed Savile had a "secret life" and was a "deeply committed paedophile". The review team spoke to the Metropolitan police officer who is believed to have sent the letter to West Yorkshire Police by fax.

He told them he had sent a number of other letters "of a similar nature" to the force, but the report said searches by West Yorkshire and the Metropolitan Police (MPS) did not manage to locate them. "The review did find that mistakes were made in how WYP recorded and handled some intelligence relating to Savile. "By 1998 process reviews, legislation, new technology and performance management have all been introduced to equip WYP to effectively and robustly manage its intelligence and information.

"However problems still occurred in how WYP dealt with the anonymous letter relating to Savile forwarded by MPS in 1998." A lawyer representing 40 of Savile's victims, Alan Collins, said the report "doesn't add up".

Mr Collins told ITV's Daybreak: "Savile was able to run rings around the police for decades. He used police officers. "The report begs a lot more questions. It provides some answers but the report reveals memories that are not as sharp as perhaps they ought to be, 'can't remember', documents that can't seem to be located."

  • A notorious unsolved axe murder from a quarter of a century ago is to be investigated by a judge.

    Theresa May will announce details later this month of an 'independent panel review' into the death of private detective Daniel Morgan. The Home Secretary's panel will have the same powers as the one that reviewed the 1989 Hillsborough tragedy and led to a new criminal investigation. Campaigners hope Mrs May's move will also trigger a new police inquiry and a successful prosecution of those responsible for killing Mr Morgan in a pub car park in Sydenham, south-east London, in 1987.

    The 37-year-old married father of two was found with the axe embedded in his head. Like the Hillsborough tragedy, the Morgan case has been dogged by allegations of police corruption. The detective's family believe he was killed because he was about to unveil a web of corruption allegedly involving his business partner Jonathan Rees and a string of police officers. Five inquiries – costing an estimated £50million – have failed to crack the case.

    Last year the Leveson Inquiry into press standards heard disturbing claims that the News of the World put the senior detective who led the fourth and fifth investigations into the Morgan murder under surveillance. Detective Chief Superintendent Dave Cook and his then wife Jacqui Hames said the suspects for the killing had encouraged the now defunct tabloid to watch them. Miss Hames told the inquiry she was being watched because 'suspects in the Daniel Morgan murder inquiry were using their association with a powerful and well-resourced newspaper to intimidate us and try to attempt to subvert the investigation'. The fifth inquiry into the murder collapsed in March 2011.

    Three men charged with the killing – Mr Rees and his brothers-in-law Garry and Glenn Vian – were cleared of involvement before their trial started. An Old Bailey judge ruled senior police had coached one of the supergrasses in the case, and it was revealed that large amounts of evidence had not been disclosed. The panel judge is expected to appoint experts but will not have the power to call witnesses. A Home Office spokesman said last night: 'Discussions are continuing with the family and we hope to make an announcement shortly.'

    masonic scotland yard Scotland Yard’s yearly requests to access telephone and postal records have jumped to nearly 57,000 amid fears of a creeping “surveillance society” in Britain.

    The Standard today reveals the growing number of requests by the Metropolitan police for surveillance of landlines, mobiles and letters. The figures, obtained under Freedom of Information laws, sparked a fresh row over existing surveillance powers and moves to extend them. Scotland Yard said the requests for surveillance powers was “crucial” in solving cases “where there is an imminent life at risk”, including kidnaps, murders and tracing missing people.

    Security minister James Brokenshire MP said: “This legislation is vital to help catch paedophiles, terrorists and other serious criminals.” But many Tory and Liberal Democrat MPs are concerned over the “snooping” powers. Esher and Walton Conservative MP Dominic Raab said: “‘Intrusive surveillance should be limited to tackling terrorism and serious crime, not snooping on ordinary citizens.”

    Campaign group Big Brother Watch, which used FOI laws to ask for communication data requests by the Met, said not enough was being done to investigate how the data already available was being used. The Met’s figures reveals that in 2009 there were more than 51,000 requests for communications data, rising to more than 56,000 in 2010 and nearly 57,000 the following year.

  • Hundreds of files on celebrities, politicians and other VIPs accused of sex attacks and abuse were so heavily protected by senior police that investigating officers could not access them, it emerged today.

    Information on high profile suspects was marked as 'secret' or 'restricted' and only available to a small number of officers - a system which may have helped prolific offenders like Jimmy Savile and MP Cyril Smith escape prosecution. The approach to sensitive files was designed to stop officers from leaking information to the media, experts say. The issue of detectives being unable to access relevant intelligence was highlighted in a report on the effectiveness of the Police National Database (PND) in the wake of the Savile scandal.

    It came after complaints about Savile made to different police forces across the country while the TV presenter was still alive were not able to be shared by detectives. Metropolitan Police Commander Peter Spindler confirmed that famous people were protected by high levels of confidentiality built into intelligence systems. 'Any high-profile or sensitive case will be restricted on our systems because we are not going to let 50,000 people (Met officers and staff) across London read sensitive material about celebrities, politicians or other high-profile people,' he told The Times.

    Jimmy Savile 'We have had some officers and staff who were prepared to leak information to the media for payment and the mechanism to prevent that was to restrict access to that information.' But police believe their new PND, launched in 2011, will help prevent similar errors in the future. The system allows sensitive material to be located but accessed only with the right clearance.

    Speaking after the report was published last week Chief Constable Mike Barton, the Association of Chief Police Officer's lead on intelligence, said the current system is capable of being interrogated by any trained officer across the UK to 'identify suspects, offenders and patterns of behaviour'. The National Association of People Abused in Childhood said that police had put the protection of celebrities before children. But spokesman John Bird added that he believes police are striving to 'get it right in future'. The first national shared database for police in England and Wales was set up in 2003, while a later system in 2006 allowed officers to search for intelligence but restricted access to sensitive records.

    Hundreds of political activists were bedding down in a field near the Drax power station in North Yorkshire. It was August 2006 and eco-activists had erected tents beside the UK's single biggest carbon emitter.

    As night fell on the inaugural Climate Camp protest the campaigners near the coal-fired station had no idea that their camp had been infiltrated by three undercover police officers. Mark Kennedy, now the most famous of police spies, and, it now seems, a woman constable known as Lynn Watson, were that night inside tents sleeping with activists. The third, an officer using the alias Mark Jacobs, would soon be doing the same with two women in Cardiff, where he posed as a truck driver to monitor small group of anarchists. The controversy over the use of sex in covert policing is too easily caricatured as wayward constables "sleeping with the enemy". But the evidence that has surfaced so far suggests police have been routinely developing close relationships with activists, and not just fleeting sexual encounters but long-term and intimate relationships that have endured several years.

    Of the nine undercover police identified by the Guardian over the past two years, eight are believed to have slept with the people they were spying on. In other words, it was the norm. On Thursday, in the latest chapter of a long-running legal dispute, some of those cases were raised at the high court in London. In a joint lawsuit, 10 women and one man say they suffered emotional trauma after forming "deeply personal" relationships with people who were later revealed to be spies. Their claim for damages threatens a deeply embarrassing court battle for the Metropolitan police, which has been trying to keep controversial details of the covert operations secret.

    The male activist who said he slept with Watson in a tent at the Climate Camp is not part of the legal action. He told the Guardian he did not want to sue the police because the one-night stand, instigated, he said, by the female officer, was "nothing meaningful". However, those who are seeking compensation from the police say they are the victims of a highly manipulative and abusive policing operation. "It is unacceptable that state agents can cultivate intimate and long-lasting relationships with political activists in order to gain so-called intelligence on political movements," said Harriet Wistrich, a lawyer for some of the women involved. The cases reveal just how intimately police have become involved in the lives of people they have been sent to spy on as part of a surveillance programme that has been in place since 1968.

    In two cases, women who were sleeping unknowingly with undercover police officers invited the men to the funerals of relatives. Police spies shared homes with the women they spied upon, met their families, told the activists they loved them and spent weeks and even months travelling with them on holidays abroad. The male claimant in the lawsuit says that an undercover police officer became his best friend before sleeping with his girlfriend. The cases go back to the 1980s, and one, which is being treated as a separate legal action, involves a woman who had a child with an undercover police officer.

    In all cases, the spies were instructed to vanish from the lives of the activists once their deployments had ended. The women were left perplexed, wondering where their loved ones had gone. All of the deployments, which cost tens of millions of pounds in taxpayers' money in total, were aimed at garnering intelligence on radical activist groups. The events have made for an unprecedented civil case.

    "No action against the police alleging sexual abuse of the kind in question in these actions has been brought before the courts in the past, so far as I have been made aware," said Mr Justice Tugendhat, the sitting judge. Lawyers for the Metropolitan police wanted all of the cases in the lawsuit struck out of the high court, arguing that instead they should be heard by a secretive tribunal that usually deals with complaints about MI5. In his ruling, Tugendhat rejected that request, saying claims for damages under common law, including torts of misfeasance in public office, deceit, assault and negligence, constituted allegations of "the gravest interference" with the fundamental rights and should be heard by the high court.

    However, the ruling was a mixed bag. In a blow to the women's legal action, the judge said that additional claims made under the Human Rights Act should first be heard by the Investigatory Powers Tribunal. The tribunal was set up in 2000 to deal with complaints from the public about unjustified state surveillance within "a necessary ring of secrecy".

    Complainants do not see the evidence from the state and have no automatic right to an oral hearing. Neither can they appeal against its decision. Wistrich described the decision to move parts of the case to the tribunal as an outrage.

    It will mean proceedings are delayed, but lawyers said they still expected large parts of the lawsuit to continue in the high court. "Even though the judge ruled that claims under the Human Rights Act should be heard by the tribunal, the common-law claims, which exist in all of the cases, can and will still be heard in the high court," said Jules Carey, another solicitor representing claimants. Future proceedings could rest on one main question: are undercover police lawfully authorised to have intimate sexual relationships with the people they are spying on? If so, under what circumstances?

    Part of the problem is that sexual activity is not specifically addressed in the Regulation of Investigatory Powers Act, the law introduced in 2000 to govern covert activities. The act states police are permitted to have "personal or other" relationships when undercover. In court documents the Met says it interpreted this statement to mean that, in certain circumstances, its officers were authorised to have "intimate and sexual" relationships. Lawyers for the women have vigorously disputed this point, saying MPs would never have thought they were condoning sexual activities when they legislated to allow covert police to form "personal or other" relationships undercover. On this, Tugendhat appears to have sided against the women. He admitted there was little clarity on the matter, but said he believed that, on balance, parliament would have envisaged "some possible sexual relationships" when introducing the legislation. Bizarrely, that conclusion appears to have rested, partly, on a reference to James Bond, dubbed by the judge "the most famous fictional example of a member of the intelligence services who used relationships with women to obtain information, or access to persons or property".

    The judge conceded that Ian Fleming, author of the Bond series, did not dwell on "psychological harm he might have done to the women concerned". But he said Bond and similar fictional examples gave credence to the view that the intelligence and police services had for many years let spies form "personal relationships of an intimate sexual nature" for intelligence purposes. In other words, he believes that when MPs authorised undercover police to get close to targets they had James Bond in mind. Tugendhat said "everyone in public life would … have assumed, whether rightly or wrongly, that the intelligence services and the police did from time to time deploy officers … in this way".

Strathclyde Police said they had examined the footage involving their officer but would be taking no action. Richard Haley, chairman of Scotland Against Criminalising Communities, said last night police officers need to accept they will be filmed by the public. He said: “The police are usually very keen to film and photograph members of the public and very shy of being filmed themselves.

    “Police have attempted in the past to use anti-terror laws to intimidate people photographing them – even journalists. Everyone now recognises that that was an abuse of the law. “The police are accountable to us, cameras are a fact of modern life and the police need to get used to it.” The Edinburgh video has 1045 views on YouTube and shows three officers arresting a man.

    Two male officers were holding him while a female officer beat his legs with a baton and shouted: “Get on the floor.” When the cameraman walks closer, another officer appears and grabs the camera. The uploader of the footage, known by his YouTube username of p59er, wrote: “I got arrested for filming them. Go figure.”

    The Glasgow video – viewed by more than 1300 users – starts when police approach a group of men after a girl in a nightclub complained about them taking her picture. One officer states it is illegal to film people in public, at which point one of the group starts their own recording. The constable tells him to stop and appears to lash out and knock the phone from his hand. The sound of it apparently smashing is heard.

    Former chair of the Scottish Human Rights Centre John Scott QC said: “People have every right to film police but there is a danger the presence of a camera could make the exchange more heated. “The officer who knocked the phone out the man’s hand needs to be mindful because he could also find himself being guilty of criminal damage.”

    FORMER West Yorkshire Chief Constable Sir Norman Bettison is at the centre of allegations he was involved in the attempted sale of stolen platinum to a Sheffield metal firm while a serving police officer 25 years ago.

    The Yorkshire Post can reveal today that detailed allegations have been referred to the Independent Police Complaints Commission (IPCC) against Sir Norman – who was an inspector in the South Yorkshire force at the time – with the watchdog being called upon to launch an investigation. A letter sent by MP John Mann and seen by the Yorkshire Post, claims Sir Norman and another man were recorded on CCTV attempting to sell a “large quantity” of stolen platinum wire to Sheffield firm Johnson Matthey on August 11, 1987.

    The wire, hugely valuable and used to monitor temperatures in the steel-making process, is believed to have belonged to another Sheffield firm where Sir Norman’s alleged accomplice worked. A well-placed source has told the Yorkshire Post officers gathered evidence against both men, but says no action was ever taken after it was referred up the chain in South Yorkshire Police. The force says, despite extensive checks, it has no record of any investigation taking place.

    Mr Mann, the Labour MP for Bassetlaw, has called for Dame Anne Owers, the chair of the IPCC, to look into the new allegations against Sir Norman alongside its ongoing Hillsborough inquiry, which is currently the subject of the biggest ever investigation into the British police. Sir Norman’s involvement in the alleged cover-up by South Yorkshire Police in the aftermath of the 1989 disaster which claimed the lives of 96 Liverpool fans, has been under the spotlight since the damning findings of the Hillsborough Independent Panel were published in September. In October, he stepped down as Yorkshire’s most senior police officer in the face of growing political pressure over Hillsborough. However he has consistently denied any wrongdoing.

    The source has told the Yorkshire Post there was an original investigation into the attempted sale of the platinum wire during which officers took witness statements, studied CCTV footage and interviewed Sir Norman’s alleged accomplice under caution. Due to the alleged involvement of a serving police officer, the source says the case was then referred to the South Yorkshire Police Complaints and Discipline Department, but never came to anything. It is understood contemporaneous evidence relating to the alleged sale of stolen platinum will be made available to the IPCC as part of any inquiry.

    “I have spoken to the same well-placed source as the Yorkshire Post and received the same detailed allegations,” Mr Mann said. “The information provided is extraordinary, and it is of great concern that these claims have only emerged now. “I am pleased that the IPCC has been presented with the opportunity to investigate and needs to get to the bottom of what happened.

    “The public will want reassuring that any investigation at the time was fully concluded by South Yorkshire Police and made known to the appointments panel when Mr Bettison was later twice appointed as chief constable. “These new claims raise yet more questions about how South Yorkshire Police was run in the 1980s. “From the information I have received, I am very surprised at allegations the officers were not asked to report in person to their superiors on the case, were not asked to be involved in further interviews with suspects and witnesses ?and were not informed of any conclusions to the investigation that they referred to the disciplinary department of South Yorkshire Police,” Mr Mann added.

    Steve Phillips, technical director of Sheffield Forgemasters one of the largest individual steelmakers in the UK who has worked for decades in the industry, says the theft of platinum wire and other precious metals from firms is a long-running issue. He says individuals are unable to trade without proper certification and a full history of where the metal came from. “There are only certain companies that will own it,” Mr Phillips added.

    It is understood the tight controls over the trade of platinum wire prompted Johnson Matthey to contact South Yorkshire Police when the alleged approach was made to the firm in 1987.

    IPCC considers letter from MP

    An IPCC spokesman said: “The IPCC can confirm it has received a letter from John Mann MP containing allegations against Sir Norman Bettison in relation to an alleged incident in 1987. “The allegations are not Hillsborough related. We will examine the information contained within Mr Mann’s letter and, given the historical nature of the information, we will have to assess how it should be dealt with.” A South Yorkshire Police spokeswoman said: “I can confirm that South Yorkshire Police have made extensive checks of our systems and records to determine whether any paperwork exists relating to this issue and we have not found any records.”

    Sir Norman Bettison was contacted at home by the Yorkshire Post but declined to comment.

    A firearms officer died yesterday after shooting himself in an apparent suicide at a city police station.

    Constable Rod Gellatly had ‘turned the gun on himself’ after arriving at work as normal yesterday morning. Police refused to give any further detail but admitted officers were not looking for anyone else in connection with the 41-year-old’s death. The incident happened at Baird Street police station in Glasgow – the Strathclyde Police base for firearms specialists, generally of constable or sergeant rank. There were unconfirmed reports yesterday that PC Gellatly had shot himself in the station’s toilets. It is understood he came to work, took a weapon and ammunition from the armoury and was later found dead by colleagues. An ambulance was called around 11am but later left with no casualty on board. The tragedy is certain to raise questions over the vetting of firearms officers who have to undergo strict psychological assessment before being allowed to carry a weapon.

    The average percentage of officers with firearms training across Scotland is around four per cent – currently around 700 out of 17,436 officers. Lothian and Borders Police was called in immediately as an independent force to investigate, while a report was sent to the procurator fiscal. An independent probe by another force is also standard practice in cases where an officer is killed in a firearms incident.

    In a statement, Assistant Chief Constable Bernard Higgins of Strathclyde Police said: ‘It is with great sadness I have to tell you that a serving Strathclyde Police officer died today in an incident where a firearm was discharged at Baird Street Police Office. ‘Our thoughts are with the officer’s family and friends at this difficult time.’ PC Gellatly is understood to have been married and lived on the south side of Glasgow.

    He served previously in the Fleet Air Arm as a Petty Officer based in the South of England between 1989 and 2002. But in recent years he had been living in the Glasgow area and serving as a policeman in Strathclyde, including spells in Wishaw and Shotts. Police are issued with a range of firearms which vary between different forces but include Heckler & Koch rifles and semi-automatic carbines and pistols, while some forces use shotguns.

    Brian Docherty, chairman of the Scottish Police Federation, said: ‘We can confirm that one of our colleagues has died following a firearms incident in Baird Street police station this morning. ‘It is too early to speculate as to the circumstances surrounding the tragic death and our thoughts turn immediately to his family who have lost their loved one and colleagues who have lost a friend.’ Labour MSP Graeme Pearson, the former head of the Scottish Crime and Drug Enforcement Agency, said: ‘It is a dreadful tragedy for the officer, his family, his friends and a terrible loss to the wider police service.

    ‘I know Strathclyde Police will support those affected with the level of professionalism one expects in the circumstances. James McIvor, 37, of nearby Pinkston Road, added: ‘It was a bit of a mystery at the start of the day then we found that a police officer was killed. ‘The fact a gun was involved makes it even more horrifying. It is a big shock for it to happen, especially in the middle of a police station.’

    Scaffolder Neil McCuaigs, 38, was working nearby at the time and said police dogs could be heard barking aggressively. He said: ‘I knew something terrible had happened straight away.’ Last night Gary Gray, 39, came to lay a poppy cross at the station with his son Bobby, eight, to ‘show respect’.

    He said: ‘I heard what had happened on the radio so I came down to show my respect. I think sometimes the police are not given the credit they deserve for the help they give us. ‘They are here to help, they do a difficult job and I think we should show our appreciation – not just for this victim but for them all.’
